BUYER: The individual or entity who accepts this agreement and purchases services through the Vistumo platform, as identified by the information provided during the order process.

2. Definitions

  • "Service" refers to the tourist tax payment facilitation service provided by Vistumo.
  • "Platform" refers to the Vistumo website (vistumo.com) and any related mobile applications.
  • "Tourist Tax" refers to mandatory levies, fees, or contributions required by destination governments for tourists.
  • "Service Fee" refers to the fee charged by Vistumo for facilitating the tourist tax payment process.
  • "Digital Service" refers to the electronic payment processing and confirmation delivery service provided by Vistumo.
  • "Order" refers to the purchase request submitted by the Buyer through the Platform.
  • "Successful Payment" refers to the moment our payment processor confirms that the Buyer's payment has been authorized and captured. The 24-hour delivery guarantee begins at this point.
  • "Full Refund" means a refund of the total amount charged to the Buyer, including both the tourist tax amount and the Vistumo service fee, credited to the original payment method. Currency exchange rate differences applied by the Buyer's bank or card issuer are outside the Seller's control.
  • "System Malfunction" means a verified technical failure in the Seller's systems or in the connection between the Seller's systems and the government portal that results in an incorrect, incomplete, or failed tax registration. Verification is based on the Seller's server logs and portal response records. If the Buyer disputes the Seller's determination, the Buyer may provide their own evidence (e.g., rejection at a government checkpoint, screenshot of an invalid QR code), which shall be considered in the evaluation. The Buyer must report a suspected system malfunction within 30 days of the transaction date.

3. Subject of Agreement

This Distance Sales Agreement ("Agreement") is entered into in accordance with the Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts (Mesafeli Sözleşmeler Yönetmeliği).

The subject of this Agreement is the determination of the rights and obligations of the parties regarding the sale and delivery of the digital services offered by the Seller to the Buyer through the Platform.

By placing an order on the Platform, the Buyer accepts all terms and conditions of this Agreement.

4. Service Description

Vistumo provides a tourist tax payment facilitation service. We act as an intermediary to help travelers pay mandatory tourist taxes required by certain destinations. Our service includes:

  • Bali, Indonesia

    Tourism levy via the Love Bali system

  • Venice, Italy

    Contributo di Accesso via Venezia Unica

  • Quintana Roo, Mexico

    VISITAX tourist tax for Cancun, Tulum, and Playa del Carmen

The service is delivered entirely digitally. Upon successful payment processing, the Buyer receives their tourist tax confirmation and QR code via email.

5. Price and Payment

The total price displayed at checkout includes:

  • The applicable tourist tax amount (as set by the destination government)
  • Our service fee for processing and facilitation
  • All applicable taxes

All prices are displayed in the selected currency at the time of purchase. The Buyer is responsible for any currency conversion fees that may be charged by their payment provider.

Payment Methods

Payments are processed securely through our PCI-DSS compliant payment processor. Accepted payment methods include:

  • Credit Cards (Visa, Mastercard, American Express)
  • Debit Cards

6. Delivery

Delivery Method: Digital delivery via email

Processing: Begins immediately upon successful payment

Delivery Guarantee: Within 24 hours of successful payment

The Buyer will receive their tourist tax confirmation and/or QR code at the email address provided during checkout. It is the Buyer's responsibility to ensure the accuracy of the provided email address.

Delivery Guarantee: If the Seller is unable to deliver the QR code or confirmation document within 24 hours of successful payment (as confirmed by the payment processor), the Buyer will automatically receive a full refund (tourist tax amount plus service fee) to the original payment method. This guarantee does not apply where delivery failure is caused by an invalid, inaccessible, or incorrect email address provided by the Buyer.

Note: As a digital service, there are no physical goods to be shipped. The service is performed and delivered electronically. Delivery times may vary depending on government portal availability, which is outside the Seller's control.

7. Right of Withdrawal & Refund Policy

No User-Initiated Cancellations & No Right of Withdrawal

Once an order is placed, processing begins immediately and cannot be cancelled by the Buyer. The 14-day right of withdrawal does not apply to this service, provided the Buyer gave express consent at checkout in accordance with Article 15/ğ of the Turkish Distance Contracts Regulation (Mesafeli Sözleşmeler Yönetmeliği, Madde 15/ğ).

Under normal circumstances, consumers have a 14-day right of withdrawal for distance contracts. However, Article 15/ğ of the Regulation provides an exception for:

"Services that are performed immediately with the approval of the consumer, where the performance of the service has begun before the expiry of the withdrawal period."

At checkout, the Buyer is required to tick an unticked checkbox expressly requesting immediate service commencement and acknowledging the loss of the right of withdrawal. This consent is recorded and included in the order confirmation email. Without this express consent, the waiver of the right of withdrawal is not valid.

For EU consumers, this is also in accordance with Article 16(a) of Directive 2011/83/EU regarding exceptions to the right of withdrawal for fully performed services where the consumer gave prior express consent and acknowledgement.

7.1 Delivery Guarantee & Automatic Refund

The Seller guarantees delivery of the QR code or confirmation document within 24 hours of Successful Payment. If the Seller is unable to deliver within this timeframe, the Buyer will automatically receive a Full Refund to the original payment method. No action is required from the Buyer. This guarantee does not apply where delivery failure is caused by an invalid, inaccessible, or incorrect email address provided by the Buyer.

7.2 Other Refund Exceptions

Refunds may also be issued in the following circumstances:

  • Technical failure on the Seller's part that prevented successful registration with the government portal
  • Duplicate charges due to system error (not user error)
  • System malfunction that resulted in incorrect tax registration not attributable to information provided by the Buyer

7.3 Non-Refundable Once Service Is Completed

Once the QR code or confirmation document has been delivered, the transaction is final. The following are non-refundable:

  • Service fees charged by the Seller
  • Tourist tax amounts transmitted to government authorities
  • Orders where incorrect information was provided by the Buyer
  • Orders where travel plans changed after payment

8. Dispute Resolution

In case of any disputes arising from this Agreement, the parties agree to first attempt resolution through direct communication. We aim to respond to all complaints within 48 hours and resolve disputes within 14 business days.

If a resolution cannot be reached, consumers may apply to the Consumer Arbitration Committees (Tüketici Hakem Heyetleri) or Consumer Courts (Tüketici Mahkemeleri) in accordance with Turkish Consumer Protection Law No. 6502.

The monetary thresholds for Consumer Arbitration Committees are updated annually by the Ministry of Trade.

EU Online Dispute Resolution

In accordance with EU Regulation No 524/2013, Article 14, consumers residing in the European Union may also use the European Commission's Online Dispute Resolution (ODR) platform to resolve disputes arising from online transactions. The ODR platform is available at: https://ec.europa.eu/consumers/odr.

9. Governing Law

This Agreement is governed by and construed in accordance with the laws of the Republic of Turkey, in particular:

  • Turkish Consumer Protection Law No. 6502 (6502 sayılı Tüketicinin Korunması Hakkında Kanun)
  • Regulation on Distance Contracts (Mesafeli Sözleşmeler Yönetmeliği)
  • Turkish Code of Obligations (Türk Borçlar Kanunu)

The courts and enforcement offices of Izmir, Turkey shall have jurisdiction over any disputes arising from this Agreement. However, for consumers in the European Union, this choice of jurisdiction shall not deprive you of the right to bring proceedings in the courts of your country of residence for consumer protection matters, in accordance with Regulation (EU) No 1215/2012 (Brussels I Recast), Articles 17-19.
